ELJO THE LABEL is a company under the laws of the Netherlands registered at Burgemeester Mullerstraat 9, 2235VG Valkenburg, the Netherlands, registered with the Chamber of Commerce under 81583842.

Throughout the website, the terms “we”, “us” and “our” refer to ELJO THE LABEL.

ELJO THE LABEL offers this website, including all information, tools and services available from this website to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Please read our terms and conditions carefully before accessing or using our website. By accessing our website and/or purchasing from us, you agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. 

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. We reserve the right to update, change or replace any part of these terms and conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.

 

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.


ARTICLE 1 - GENERAL CONDITIONS
1.1 By agreeing to these terms and conditions, you represent that you are at least the age of majority in your state or province of residence.
1.2 We reserve the right to refuse any service and any order to anyone for any reason at any time and we reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. We may exercise this right on a case-by-case basis.

1.3 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, without express written permission by us. 
1.4 You may not use our products and services for any illegal or unauthorized purpose nor may you, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of our terms will result in an immediate termination of our services to you.

1.5 The website and all the content on it are owned by ELJO THE LABEL or its licensors. The information and all content are protected by intellectual property and marketing laws. This means that trademarks, trade names, product names, images, graphics, design, layout, and information about products, services, and all other content (excluding user generated content) may not be copied or used without written approval from ELJO THE LABEL.



ARTICLE 2 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
2.1 We are not responsible if information made available on this website is not accurate, complete or current. We reserve the right to modify or discontinue the contents of this website at any time without notice, but we have no obligation to update any information on our website. You agree that it is your responsibility to monitor changes to our website.

2.2 Occasionally there may be information on our website or in the service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).



ARTICLE 3 - PRICES
All prices mentioned on the website of ELJO THE LABEL are inclusive 21% VAT. We offer free shipping on orders above €150,- in the Netherlands. Check our Shipping page for more information about costs of international shipping. 

Please note ELJO THE LABEL is not responsible for paying duties and taxes on orders. As long as the agreement has not been set yet, ELJO THE LABEL is free to change the prices and further conditions without notice.

ARTICLE 4 - PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, so we can contact you as needed.


We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.


ARTICLE 5 - DELIVERY
5.1 ELJO THE LABEL aims to ship all orders that are in stock within 1-2 working days. If a product has a longer delivery time or is (temporarily) not deliverable you will be informed shortly after you have placed the order. Please note our delivery times are provided as guidelines only and do not take into account delays caused by any reason.
5.2 ELJO THE LABEL is not responsible for delays caused by our shipping providers Post NL or DHL. 
5.3 ELJO THE LABEL is also not liable for whatever damage that might occur as a consequence to not delivering in time. 
5.4 We always try our best to deliver your order complete and on time. If something is missing from your order or you receive an incorrect or damaged item, you immediately need to report this to us by e-mail: contact@eljothelabel.com.

ARTICLE 6 - PAYMENT
The agreement for buying and selling is realized the moment that you accept and comply with the general terms & conditions of ELJO THE LABEL. The due payment must be made upfront using one of the offered online payment methods. The payments are handled by Shopify Payments, an online payment provider.  

ARTICLE 7 - RECLAMATIONS & RETURNS
7.1 We do the best we can to deliver a perfect product. ELJO THE LABEL advises to check the delivered products immediately after receiving them. In case the ordered products do not satisfy your expectations, do not hesitate to contact us by mail in order to inform us about it. ELJO THE LABEL will try to solve the problem or complaint together with you. 
In case we have not received a written complaint within 14 days after the reception of the product, we assume that the product(s) has been delivered correctly and in good state. 
7.2 You have the right to return the products delivered by ELJO THE LABEL within 14 days. Within the approval period of 14 days you are obliged to take great care of the product and the packaging. You are only allowed to unpack and use the product as far as necessary to test whether it satisfies you and you would like to keep it. Goods returned must be unused and intact, in the original packaging with the original hangtag on. In case that the products are not used and returned correctly in time and undamaged ELJO THE LABEL will refund the paid price exclusive shipping costs within 14 days. If the products sent by ELJO THE LABEL are not returned within 14 days the agreement is valid. 
7.3 Returns that have been worn or used, damaged, soiled, altered or returned after the 14 days may not be accepted and may be sent back to the customer.

ARTICLE 8 - DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
8.1 You expressly agree that your use of, or inability to use, our website, services and is at your sole risk. 
8.2 ELJO THE LABEL is not liable for any damages, injuries, losses or claims, caused, directly or indirectly, by the employees, interns, agents, suppliers or service providers ELJO THE LABEL. 
8.3 ELJO THE LABEL is also not liable for any damage caused by third parties.
8.4 ELJO THE LABEL accepts no liability for eventual damages, injuries, losses or claims, that are directly or indirectly caused by our products or services or the use of our products or services. The liability of ELJO THE LABEL is always restricted to the purchase amount of the product in question.
8.5 ELJO THE LABEL is not liable for misunderstandings, delay and incorrect delivery of orders and messages, due to the use of the internet or other means of communication with ELJO THE LABEL, or between ELJO THE LABEL and third parties, unless due to intentionally acts or negligence.
8.6 Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

ARTICLE 9 - FORCE MAJEURE
In a situation of force majeure all obligations of ELJO THE LABEL will be canceled. In case that the period of force majeure takes longer than two months, it is yours and ELJO THE LABEL’s right to cancel the agreement, without a compensation for damage. We speak of force majeure in case of strike, disturbances, import/export prohibition, or natural disasters regardless if these occur at ELJO THE LABEL or its suppliers.


ARTICLE 10 - THIRD PARTY

We may provide you with access to third-party tools/links over which we neither monitor nor have any control nor input. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools/links. Any use by you of optional tools offered through the website is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, so we can contact you as needed. ELJO THE LABEL respects the privacy of all users of its website and ensures that your personal information you provide is treated confidentially. By signing up, you agree that we store and use your personal information to meet your expectations regarding delivery, delivery information and customer service. Your submission of personal information through the store is governed by our Privacy Policy.

For this agreement and terms & conditions Dutch law applies.
